Kathmandu, May 21: President Vidyadevi Bhandari has given 21 hours to the parties to form a new government, saying that the constitution has been violated.
Despite the constitutional provision that the process of forming a new government will begin if the Prime Minister resigns or resigns due to a vote of no-confidence, various political parties, constitutionalists and lawyers have protested against the President’s call for the formation of a new government. The main opposition parties, the Nepali Congress and the Maoist Center, have said that the move by the Prime Minister and the President was unconstitutional.
Nepali Congress leader Gagan Thapa said, “Let’s form a new government before the time given by the president and dismiss Oli. Let’s dismiss the president by filing an impeachment.”
Similarly, constitutionalist Bhimarjun Acharya has said that the Prime Minister tried to dissolve the parliament with a mall-intention. In a tweet, Acharya said, “There is no constitutional provision to call for the formation of a new government before the vote of confidence begins.” The formation of another government cannot be recommended until the prime minister resigns by a vote of confidence. It seems that the Prime Minister of Article 76 (3) is trying to dissolve the parliament. ‘
Writer and analyst Vishnu Sapkota wrote, “I am never surprised by the irony of Oli and the President’s every move from the beginning.” If they hadn’t, I’d have been a little surprised! ‘
According to Article 76, Clause (3) of the Constitution, a person who has become the Prime Minister as the leader of largest parliamentary party in the House of Representatives must obtain a vote of confidence from the House of Representatives within 30 days from the date of appointment. If the Prime Minister fails to get a vote of confidence within 30 days, there is a clear constitutional provision that the process of forming a government will proceed in accordance with Article 76 (5) of the Constitution.
According to this provision, if Prime Minister Oli does not get a vote of confidence by mid-June, this option will be open. But calls have been made for a new government without a vote of no confidence or resignation.
