Question from the Chief Justice: Can a court make a Prime Minister?

Kathmandu : Chief Justice Cholendra Shamsher JBR has questioned whether the court can appoint a prime minister ?

While the legal practitioners of Speaker Agni Prasad Sapkota were debating on the writ petition related to the dissolution of the House of Representatives on Sunday, Chief Justice JBR questioned whether the practice of appointing the Prime Minister by the court was good.

During the debate, advocate Meghraj Pokharel had demanded that Sher Bahadur Deuba should be appointed as the prime minister as his demand for the appointment of the prime minister would be met as per Article 76950 of the constitution.

‘146 people appeared in court. (Signing to make Deuba the Prime Minister) 2/3 of the 149 people were upset. But the vote of confidence is enough. The court should take this into consideration, ”he said during the debate.

Then Chief Justice JBR asked, “Is this what the court is trying to say here (146)?” 146. Now it has been argued that the court should accept it and certify it. Is it better to practice it? Is this the interpretation of 76 (5)? ​​’He asked.

After President Vidyadevi Bhandari started the process of appointing the prime minister as per Article 76 (5) of the constitution, Deuba had claimed to be the prime minister with the signatures of 149 parliamentarians. Similarly, Prime Minister KP Sharma Oli himself.
