Senior Advocate Bhandari’s Argument: ‘President’s decision shows bad intention, Deuba has grounds to get vote of confidence’

Kathmandu : Senior Advocate Savita Bhandari has said that the decision of President Vidyadevi Bhandari not to appoint Sher Bahadur Deuba as the Prime Minister has shown bad intention.
Debating on a writ petition seeking restore the dissolution of the House of Representatives and the appointment of Sher Bahadur Deuba as prime minister, Bhandari said the president had exercised a power she did not have.
She should have appointed Sher Bahadur Deuba as the Prime Minister with the signatures of 149 MPs. As 146 MPs came even with the writ petition, there is a basis for him to get a vote of confidence, ‘she said.

She claimed that the provision of Article 76 was made for the members of parliament and not for the five parties.
“This is a provision of the constitution that you, the parliamentarians, can form the government if the parties cannot form a government,” she said.
She claimed that Prime Minister KP Sharma Oli did not even have the right to demand re-election.
“According to Article 76 (3), the PM has no right to go again if he does not get a vote of confidence,” she said.
