Kathmandu May 24 : A total of 146 lawmakers from the opposition alliance have filed a writ petition in the Supreme Court seeking restoration of parliament and appointment of Nepali Congress leader Sher Bahadur Deuba as prime minister.
Last Friday at midnight, on the recommendation of the government, President Vidyadevi Bhandari dissolved the parliament and announced mid-term elections on November 12 and November 19. Calling it unconstitutional, the Opposition Coalition has filed a writ petition under Article 76 (5) with the signature of the lawmaker who supported Deuba’s claim. Among those who supported Deuba as prime minister in the president’s office, three MPs refused to sign the writ petition.
Major there Demands
- Reject the decision of the Council of Ministers to recommend the dissolution of Parliament
- The date of the Parliament session should be fixed
- Order to appoint Sher Bahadur Deuba as the Prime Minister as per Article 76 (5) of the Constitution.
This is the first such writ in the history of Nepal. This is the first time a writ petition has been filed demanding the restoration of the parliament with the signatures of about 55 percent members of the current parliament.
About a dozen writ petitions were registered after the dissolution of the parliament by Prime Minister KP Sharma Oli on Push 5. At that time, only four members of the opposition coalition had filed a writ petition. Parliament was reconstituted on Phagun 11.
