Kathmandu, May 22: Speaker Agni Prasad Sapkota has issued a statement saying that the dissolution of the parliament is unconstitutional. In a statement issued on Saturday, Speaker Sapkota claimed that the dissolution of the parliament was against the decision of the Supreme Court on February 25.
Sapkota’s statement said, “It is worth mentioning that the dissolution of the House of Representatives in the absence of the essence and purpose of the constitution is unconstitutional.
The statement issued by the Office of the President on May 21, 2021 does not seem to be in line with the provisions of the Constitution of Nepal, the Political Parties Act 2073 and the Rules of the House of Representatives 2075. That has gone against the principle of separation, balance and control of power. ‘
According to Article 76 (5) of the Constitution, Sapkot argues that the parliament should not be dissolved with the option of appointing a prime minister once the objective basis for the formation of an alternative government has been laid.
