‘Provision of positive discrimination should not be repeated’ : Supreme Court

Kathmandu : The Supreme Court’s latest decision to make the reservation system more targeted rather than ethnic or class has been made public.

The full text of the judgment passed by Justices Bishwambhar Prasad Shrestha and Ananda Mohan Bhattarai on December 22 has now been made public.

In the decision, the government has been ordered to free the reservation from the middle class belonging to ethnic or class groups and extend it to the people who need real reservation.

“While it is necessary to make the reservation system goal-oriented and equitable, it is necessary to free the reservation system from the control of the upper class (Creamy layer) ‘Taramara’ lavish middle class, which is constitutionally reserved but does not need reservation due to personal progress,” the full text of the verdict said.

The decision also stipulates that the system of repeatedly making reservations available to the same person or family should be abolished.

‘Provision of positive discrimination should not be repeated in the same person or family over and over again and should be monitored, evaluated and reviewed objectively from time to time. Since it can only pursue the goals of the constitution, it is necessary to pay special attention to policy and law making in this regard as well, ”the decision concluded.
