After the ordinance was repealed, the officials appointed by the Oli government filed another writ saying it was illegal

Kathmandu : Following the repeal of the Constitutional Council Ordinance, a supplementary petition has been filed in the Supreme Court alleging that the office bearers appointed by the KP Oli government are illegal. Senior Advocate Omprakash Aryal has filed a supplementary petition in the Supreme Court alleging that it would be illegal for 52 office bearers of the constitutional body to remain in their posts as the ordinance issued on December 12 has been automatically deactivated as per Article 114 of the Constitution.

Even after the repeal of the ordinance issued on 2078/1/21, B.S.52 office bearers of the said constitutional bodies are still working in their posts. As the legal basis for appointment has been completely exhausted, it is illegal for the office bearers of the constitutional bodies appointed on the basis of the ordinance to remain in office as before, ”the supplementary petition claimed.


Earlier, Aryal had filed a writ petition in the Supreme Court challenging the appointment recommendation and other appointments made by the Constitutional Council. On the strength of the ordinance, appointments were made to vacant posts in various constitutional bodies.

Among them are Prame Kumar Rai as the Chief Commissioner of the Commission for Investigation of Abuse of Authority, Kishore Kumar Silwal and Jai Bahadur Chand as the Commissioners, Ram Prasad Bhandari as the Commissioner of the Election Commission and Dr. Janaki Tuladhar, Tap Bahadur Magar as the Chairman of the National Human Rights Commission and Dr. Surya Prasad Sharma Dhungel, Mihir Thakur, Manoj Duwadi and Lily Hazur Basnyat as the members, Judd Bahadur Gurung and Amar Raj Mishra as the members of the National Natural Resources and Finance Commission.

Kamala Kumari Parajuli is the chairperson of the National Commission for Women and Krishna Kumari Poudel and Vidyakumari Sinha are the members. Devraj Vishwakarma is the chairperson of the National Dalit Commission. Meenadevi Sov, Tunje Kami and Mehle Parki are the members. Among the members are Dr. Min Bahadur Shrees, Reena Rana and Sharan Rai, members of the Madhesi Commission are Jivach Sah, Renu Devi Sahar, Vijay Kumar Gupta, members of the Tharu Commission are Subodh Singh Tharu and Bholaram Chaudhary, members of the Muslim Commission are Mahmadin Ali and Mirza Arshad Vegal.
