The document sent by the President to the Supreme Court is sealed on the dissolution of the HoR

Kathmandu: The three-day-long debate in the Supreme Court on the dissolution of the House of Representatives has repeatedly raised questions about the documents submitted by the two prime ministerial contenders and the president’s decision to reject both. However, it is not clear what documents the duo has submitted.Preparations are underway to send the documents submitted by the two contenders for the post of Prime Minister directly to the President’s Office

The documents sent to the Supreme Court by the President’s Office have not been made public. Both sides are making allegations against each other over the claims.

What is Oli’s demand and claim ?

Prime Minister KP Sharma Oli had sent a letter from the UML parliamentary party to the President’s Office claiming himself as the Prime Minister as per Article 76 (5) of the Constitution. It also contained a letter signed by Mahanta Thakur and Rajendra Mahato of the Janata Samajwadi Party (JSP). According to a Supreme Court source, Oli’s demand did not disclose the number of MPs in the UML parliamentary party. The letter does not even have a list of MPs.

During the debate on the issue of dissolution of the House of Representatives, advocate Tikaram Bhattarai said that Oli’s demand did not even include the names and signatures of the lawmakers. ‘The letter demanding to be made the Prime Minister does not even have the signatures of the MPs.

“We are ready to send the documents directly to the bench,” Baburam Dahal, chief of the Supreme Court’s case division, informed. “The bench will look into the documents and then act according to the order.”

Prime Minister Oli had said in a meeting with journalists on the afternoon of May 22 that he would not run for the post of Prime Minister. In the evening of the same day, the then Congress parliamentary party leader Sher Bahadur Deuba was preparing to submit the signatures of 149 parliamentarians for the post of prime minister. In a few hours, the UML parliamentary party did not even hold a meeting.

Prime Minister Oli had claimed that he had the support of all 32 MPs of the JSP. He had submitted a letter signed by JSP Chairman Mahanta Thakur and parliamentary party leader Rajendra Mahato. However, Mahato was not recognized as the leader of the parliamentary party as he was not registered with the Parliament Secretariat also.

The two-party system requires the signatures of Thakur as well as another chairman, Upendra Yadav, for a decision. The Yadav faction did not consider Mahato as the leader of the parliamentary party.
