JSP dispute : the E C sought a written reply from Thakur’s faction

Kathmandu. The Election Commission has started the process of resolving disputes within the Janata Samajwadi Party.

After the Upendra Yadav faction submitted a letter to the Election Commission on June 18 asking it to resolve the dispute over the decision of the Central Executive Committee, the Commission has demanded a written reply from Mahanta Thakur’s faction.

The meeting of the commission has given 15 days notice to the Thakur faction to submit a written reply on the Yadav faction’s claim. At the same time, the Election Commission has entered into resolving the dispute over the authenticity of JSP.

The decision of the Commission states, “On behalf of the Janata Samajwadi Party Nepal, the decision of the Central Executive Committee of the party and the necessary documents as per clause (c) of Article 43 of the Political Parties Act 2073 should be disputed. In order to submit a written reply to the petition as per sub-section 2 of section 44 of the Political Parties Act, 2073 BS, a copy of such claim and evidence should be attached to the Chairman of Janata Samajwadi Party, Nepal, Mahanta Thakur. To be submitted as per the rules after or beyond the period.

Earlier, the commission had rejected the plea of ​​Upendra Yadav and Mahanta Thakur to take action against each other and correct the details in the party registration book. At that time, the commission had said that the dispute was about the official status of the party and requested to come for settlement as per Article 44 of the Political Parties Act.

After that, Upendra Yadav’s faction had filed a petition on June 18 claiming the party’s authority along with the decision of the Central Executive Committee.

Article 44 (1) of the Political Parties Act stipulates that in case of dispute over the party’s authority, the party claiming the authority of the decision of such office bearer, Central Committee or Central Committee must submit the claim to the Commission within 30 days from the date of commencement.

Article (2) of the Act provides that the Commission shall then inform the other party to submit a written reply to the claim.
