Hearing on writ against dissolution of House of Representatives from today

Kathmandu May 27 : Of the writ petitions filed in the Supreme Court against the dissolution of the House of Representatives, 19 have been heard since today. Many are interested in whether an interim order will be issued in the writ.
As many as 30 writ petitions were filed in the Supreme Court against the President’s dissolution on May 22 on the recommendation of the Prime Minister. Of these, 19 writ petitions will be heard on today. 11 writs have been registered in the Constitutional Court. The Supreme Court has stated that they will be presented in the sitting on Friday.

Most of the writs have been registered through simple process. The petitioners have stated that they have not registered in the constitutional session with the intention of taking it to the general session. “We have not registered with the Constitutional Court to bring it to the grand bench,” said Dinesh Tripathi, a senior advocate among the petitioners.
In the first instance of the Supreme Court, the petitioner and the lawyer practicing on his behalf will argue. According to senior advocate Tripathi, an order may come from the bench to look into all the petitions in one place.

Constitutionalistist Rudra Sharma said that the previous decision on dissolution had already been taken and the current dissolution was against it, adding that an interim order could be issued on the first day. He said that it would have been easier if the full text of the previous verdict had come. Sharma had also debated the issue against the earlier dissolution.
“It simply came to our notice then. The Supreme Court has already explained the basis of the dissolution and the articles of the constitution in the decision of the previous dissolution case. So it probably won’t last very long. If the session is convincing, it can give an interim order, ”Sharma said. He said that some writs have also raised disputes related to elections and political parties.

Sharma said there was a possibility of an interim order as it was time to bring the jet. He added, “MPs have identified themselves in favor of Sher Bahadur Deuba.” This shows that Deuba’s claim was correct. Therefore, the order to appoint him may come tomorrow. ‘
The lawmakers, including Deuba, have also raised the issue of action to be taken on the basis of election and political party law in the writ petition filed in the Constitutional Court. Sharma said that an immediate order could be issued to hear these issues in detail later.

Earlier, the Supreme Court had ruled on the issue of dissolving the House of Representatives in about two months. At that time, there were daily hearings. However, this time the corona virus infection is terrible, so it has not been decided how to hear. Supreme Court Communication expert Kishor Poudel said the debate could also be virtual.
